Guardianship & Conservatorship
What is a Guardianship?
A guardianship is a legal relationship where the court grants someone (the guardian) the power to make decisions about the personal well-being of an incapacitated adult or minor (the ward).
Guardians may make decisions about where the ward lives, their medical care, education (for minors), and important aspects of their life.
What is a Conservatorship?
A conservatorship, formerly known as guardianship of property, is a legal relationship where the court grants someone (the conservator) the power to manage a person's property and finances.
Conservators can pay bills, manage investments, file taxes, and handle the financial affairs of the ward.
Key Differences
Guardianship focuses on the person's well-being.
Conservatorship focuses on management of the person's assets.
It's very common for an individual to need both a guardian and a conservator, and the court may appoint the same person to serve in both roles.
Why Consider Guardianship or Conservatorship?
These arrangements are often helpful when a person:
Has a severe or progressive illness that impairs their judgment.
Is a minor in need of guidance and care.
Suffers from a mental disability making it impossible to manage their own affairs responsibly.
Is vulnerable and at risk of being exploited by others.
